When you visit nutrimart.co.za (the “Website”), and more generally when you use any of our services (the “Services”, which include the Website), you trust us with your personal information. This notice explains what we collect, how we use it, and what rights you have. If you do not agree with it, please stop using our Services.

This notice applies to information collected through our Services, including the Website, and to related sales, marketing, and events.

1. What information do we collect?

In short: some information — such as your IP address and your browser and device characteristics — is collected automatically when you visit the Website.

When you create an account or place an order, we also collect the details you give us, such as your name, email address, phone number, delivery address, and order history. Card details are entered on our payment provider’s secure page and are not stored by NutriMart.

2. How do we use your information?

In short: we process your information for legitimate business interests, to fulfil our contract with you, to comply with legal obligations, and where you have consented.

We use personal information collected via the Website for the purposes below. The ground we rely on is a legitimate business interest, a contract with you, your consent, and/or a legal obligation.

• Account creation and sign-in. If you link your account to a third-party account (such as Google or Facebook), we use the information you allowed us to collect from that service to create and sign you in, so we can perform our contract with you.
• Testimonials. We may post testimonials that contain personal information. We will obtain your consent before using your name and testimonial. To update or delete a testimonial, email online@nutrimart.co.za with your name, where the testimonial appears, and your contact details.
• Feedback. We may contact you about your use of the Website and ask for feedback.
• User-to-user communications. We may use your information to enable communications between users, with each user’s consent.
• Account management. We use your information to keep your account in working order.
• Administrative messages. We may send product, service, and new-feature information, and notice of changes to our terms, conditions, and policies.
• Protection of the Services. We use information to keep the Website safe, including fraud monitoring and prevention.
• Terms and legal compliance. We use information to enforce our terms, conditions, and policies, to meet legal and regulatory requirements, and in connection with our contract with you.
• Legal requests and harm prevention. If we receive a subpoena or other legal request, we may need to inspect the data we hold in order to respond.
• Orders. We use your information to fulfil and manage orders, payments, returns, and exchanges made through the Website.
• Prize draws and competitions. We may use your information to administer prize draws and competitions you choose to enter.
• Delivery of services. We use your information to provide the service you requested.

We also share what is needed with service providers who deliver the order or take payment, such as our courier and payment gateway. They may use that information only to perform those services.

We may use cookies and similar tracking technologies (such as web beacons and pixels) to access or store information. You can refuse non-essential cookies from the cookie banner or from Cookie settings in the footer. Necessary cookies stay on so checkout and sign-in keep working.

5. Is your information transferred internationally?

In short: we may transfer, store, and process your information in countries other than your own.

NutriMart operates this Website for customers in South Africa. If you access it from another country, your information may be transferred to, stored, and processed in South Africa and by service providers we use to run the store (see “Will your information be shared with anyone?” above).

If you live in the European Economic Area, those countries may not have data-protection laws as comprehensive as your own. We still take the measures described in this notice, and required by applicable law, to protect your personal information.

6. What is our stance on third-party websites?

In short: we are not responsible for the safety of information you share with third parties who advertise on, but are not affiliated with, our Website.

The Website may contain advertisements or links from third parties that are not affiliated with us. We cannot guarantee the safety and privacy of data you provide to them. Data they collect is not covered by this notice. We are not responsible for the content or privacy practices of other websites, services, or applications linked from the Website. Review their policies and contact them directly.

7. How long do we keep your information?

In short: we keep your information for as long as needed for the purposes in this notice, unless the law requires longer.

We keep personal information only for as long as necessary for the purposes set out here, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice requires us to keep your personal information for longer than the period you have an account with us, except where the law says otherwise.

When we no longer have a legitimate business need to process your personal information, we will delete or anonymise it. If that is not possible — for example because it is in backup archives — we will store it securely and isolate it from further processing until deletion is possible.

8. How do we keep your information safe?

In short: we aim to protect your personal information with organisational and technical security measures.

We have implemented technical and organisational measures designed to protect personal information we process. No electronic transmission or storage technology can be guaranteed 100% secure, so we cannot promise that unauthorised parties will never defeat those safeguards. Transmission of personal information to and from the Website is at your own risk. Access the Website only from a secure environment.

9. Do we collect information from minors?

In short: we do not knowingly collect data from or market to children under 18.

We do not knowingly solicit data from or market to children under 18. By using the Website, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to that minor’s use of the Website. If we learn that we have collected personal information from someone under 18, we will deactivate the account and take reasonable steps to delete that data. 10. What are your privacy rights?

In short: you may review, change, or close your account at any time.

Account information. To review or change the information in your account, or to close it, sign in and update your account, or contact us. If you ask us to close your account, we will deactivate or delete it from our active databases. We may retain some information to prevent fraud, troubleshoot problems, assist with investigations, enforce our terms, and comply with the law.

Cookies. Most browsers accept cookies by default. You can usually set your browser to remove or reject cookies. Doing so may affect some features of the Website. You can also change Analytics and Marketing cookies from Cookie settings on this site.

Email marketing. You can unsubscribe from marketing email at any time by using the unsubscribe link in those emails or by contacting us. We may still send service messages that are necessary to run your account, answer a request, or for other non-marketing purposes.

11. Controls for do-not-track features

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) setting that signals a preference not to have browsing activity monitored. There is no uniform standard for recognising DNT signals. We do not currently respond to DNT browser signals or other automatic do-not-track mechanisms. If a standard we must follow is adopted, we will describe that practice in a revised version of this notice.

NutriMart takes all reasonable steps to protect the personal information of users. For this notice, “personal information” has the meaning given in the Promotion of Access to Information Act 2 of 2000 (PAIA).
